The Customer undertakes to communicate personal data and not those of third parties and in any case to communicate truthful, not fictional or inventive data. In any subsequent communication to the Order, the Customer must use the Order number communicated by the Seller. 5. Methods of payment and / or billing 5.1. Terms of payment. The customer can pay using one of the following payment methods: paypal, credit or prepaid card, bank transfer. 5.2. Payment method by credit card. Payment by credit card must be made according to the instructions indicated on the Site and the credit cards accepted by the Seller are: Visa and MasterCard. The Customer, by indicating the credit card as a payment method, authorizes the Seller to use his credit card and to debit the amount of the expense incurred. 5.3 Time of payment and default interest. The Customer will pay the full price of the Products ordered, including transport costs and costs relating to the chosen payment method, after placing the Order. In case of payment by bank transfer, the Customer must pay within 2 (two) working days from receipt of the "Shipping Confirmation" which will indicate the bank details on which to make the payment. In the event of non-payment, the Seller will not ship the Products until full payment has been made. In case of payment by credit card, the Seller will debit the amount due by the date of shipment of the Products. In case of late payment, the Customer will be owed default interest in accordance with Legislative Decree 231/2002 and its subsequent amendments. Invoice issuance. The Seller will issue the invoice and this will be attached to the Products delivered and / or also sent in electronic format. No changes to the tax documents can be made after their issue. Change of ownership. The Products remain the property of the Seller until they are delivered to the Customer. 6. Delivery of products 6.1 Methods and deadlines for shipping. The shipment of the Products will take place in the manner chosen by the Seller, within 5 (five) working days from the Order Confirmation. 6.2 Failure to collect the Products. In the event that the Customer is not found at the address provided for the delivery of the Products and the latter are returned to the Seller, the Customer will be obliged to pay any price not paid before sending the Products. The Customer authorizes the Seller to charge the storage costs incurred due to the delay in delivery of the Products attributable to the Customer, with the amount due by credit card, if the payment agreed was by credit card. If the Customer has chosen bank transfer as a payment method, he undertakes to pay the Seller the costs of storing the Products within 2 (two) working days from the payment request sent by email from the Seller to the Customer. 6.3 Risk of loss or damage to the Products. The risk of loss or damage to the Products during transport will remain with the Seller until delivery to the Customer. Warranty 7.1. Term of forfeiture and prescription. If the Customer finds flaws and defects in the Products purchased, he can contact the Seller, under penalty of forfeiture, within 48 hours of delivery, and report the defect. After this deadline the Seller will not be responsible for defects found by the Customer. 7.2 Notice of Defect. The Seller invites the Customer to describe in as much detail as possible the nature of the defect found and possibly to send a copy of the Order documents, indicate the Order number, and any other data useful for the correct identification of the complaint. 7.3 Repair or replacement. The Seller will, as the case may be, replace the Product within a reasonable period of ascertaining the actual existence of the defect. In case of impossibility of replacing the Product, the Customer will have the right exclusively to the refund of the price paid, excluding any and all damages. In order to return goods to the bidder, the customer must have the relevant purchase document. The return of the goods is at the expense and under the responsibility of the customer. Goods sent by mistake are returned only in their original unopened and non-defective packaging. Law 50/92 applies to private customers: The customer can change his mind within 7 days of placing the order. The customer who changes his mind must communicate it by letter A.R. to the bidder. The customer must return the goods to the bidder at his own expense. The bidder reserves the right to replace a product with an equivalent product. 7.4 Disclaimer of Warranty. The Products will not be covered by any warranty for defects in the event that the Customer has made an incorrect use of the Products, or if the Products have been altered or modified or have been stored in an inappropriate manner taking into account the characteristics of the Products. 7.5 Withdrawal of defective Products. The Customer undertakes to support the Seller in the withdrawal from the market of any defective Products or in the event of recall campaigns. 8. Limitation of Liability The Seller is solely responsible for direct and foreseeable damages at the time of conclusion of the Contract, except in the case of willful misconduct and gross negligence. The Seller is therefore not responsible for any losses suffered, lost earnings or any other damage suffered by the Customer that is not an immediate and direct consequence of its non-fulfillment, or that was not foreseeable at the time of the conclusion of the Contract. 9. Non-prejudice clause Failure by the Seller to exercise the rights provided for in this Agreement, as well as a behavior of tolerance in certain situations in which he can assert his rights, does not entail the renunciation of the right towards the Customer. 10. Applicable law and competent court These General Online Sales Conditions are governed by Italian law. Any dispute relating to the interpretation and execution of the Contract is devolved to the exclusive jurisdiction of the Court of Trieste. Pursuant to and for the purposes of articles. 1341 and 1342 of the Civil Code, the Customer declares to specifically accept the following unfair clauses: art.1 "Prices"; art. 5 "Methods of payment and invoicing"; art.6 "Delivery of Products"; art. 7 "Warranty"; art. 8 "Limitation of Liability"; art. 10 "Applicable law and competent court". www.deliziedellealpi.it (in seguito, “Delizie delle Alpi”), Delizie delle Alpi SAS di Lugnani Bruno & C., sono disciplinati dalle presenti Condizioni generali di vendita (in seguito, “Condizioni Generali”), formulate in conformità alla vigente normativa sui contratti conclusi al di fuori dei locali commerciali. Con la trasmissione di un ordine, si dichiara di aver letto, compreso e accettato le presenti Condizioni generali di vendita.
Delizie delle Alpi si riserva in qualsiasi momento il diritto di modificare le presenti Condizioni generali di vendita pubblicandone la nuova versione sul sito web www.deliziedellealpi.it (in seguito, il Sito). Le Condizioni generali di vendita applicabili sono quelle vigenti al momento in cui viene effettuato l’ordine.
Le presenti Condizioni Generali hanno l’obiettivo di disciplinare l’acquisto dei prodotti e dei servizi resi disponibili dal Sito nel rispetto della normativa italiana in tema di contratti a distanza ( D. lgs. 70/2003).

Il Cliente è tenuto, a leggere attentamente le Condizioni Generali, prima dell’invio dell’ordine. Tali Condizioni Generali sono state messe a disposizione sul Sito per consentire la riproduzione, comprensione e memorizzazione.
I contratti conclusi con Delizie delle Alpi attraverso il Sito sono regolati dalle presenti Condizioni Generali nel rispetto della normativa italiana.

Il prezzo dei vari Prodotti come pure le relative descrizioni e caratteristiche sono riportati nella pagina relativa a ciascuna Categoria ed in dettaglio nella pagina di ciascun Prodotto.
Per l’acquisto dei Prodotti il Cliente dovrà aggiungere il Prodotto al “Carrello” ed in seguito compilare e inviare il modulo d’ordine in formato elettronico, inserendo i dati di fatturazione e di spedizione seguendo le istruzioni contenute nel Sito. Dopo aver preso visione e accettato, mediante la selezione di un apposito campo, delle Condizioni Generali e della Privacy Policy, il Cliente dovrà selezionare la modalità di pagamento desiderata e confermare l’ordine. Accettando i Termini e Condizioni di questo sito si accetta anche la Privacy Policy
Una volta inviato un ordine, al cliente comparirà una pagina di Conferma dell’Ordine. Tale conferma dell’ordine ha valore di proposta contrattuale e con essa il Cliente riconosce e dichiara di aver preso visione di tutte le indicazioni fornitegli durante la procedura d’acquisto e di accettare integralmente le presenti Condizioni Generali e di pagamento.
Il contratto stipulato tra Delizie delle Alpi ed il Cliente deve intendersi concluso con l’accettazione dell’ordine da parte di Delizie delle Alpi. Tale accettazione viene comunicata al Cliente attraverso un’email di Conferma dell’ordine stesso all’indirizzo indicato dal cliente in fase di registrazione e/o di conclusione dell’ordine.
Sul Sito web www.delizidellealpi.it non vi è un valore d’ordine minimo d’acquisto, tuttavia si offre al Cliente la possibilità di usufruire della spedizione omaggio per ordini superiori a € 99 iva inclusa.

1. PREZZI
I prezzi esposti sul Sito web sono tutti comprensivi di IVA ed espressi in Euro, unica valuta accettata da Delizie delle Alpi.
I prezzi applicabili per i prodotti ordinati sono quelli che risultano su questo sito alla data di trasmissione dell’ordine. Tali prezzi sono da intendersi IVA inclusa. Non sono incluse invece le spese di spedizione.
Le spese di consegna sono fatturate sulla base delle tariffe indicate su questo sito alla data in cui viene effettuato l’ordine. Tali tariffe sono definite in funzione della dimensione dell’ordine e della modalità di consegna
Delizie delle Alpi si riserva il diritto di modificare in ogni momento i prezzi dei prodotti e le spese di spedizione e di annullare un ordine in caso di errore evidente nel sistema di calcolo o nei dati. Un eventuale pagamento ricevuto verrà rimborsato al cliente, al netto delle spese di incasso e di successivo invio sostenute.

Viene escluso ogni diritto del Cliente a un risarcimento danni o indennizzo, nonché qualsiasi responsabilità contrattuale o extracontrattuale per danni diretti o indiretti a persone e/o cose, provocati dalla mancata accettazione o evasione, anche parziale, di un ordine.

Le rappresentazioni visive e fotografiche dei prodotti sul Sito, sono solo a corredo della scheda di descrizione. Resta inteso che l’immagine fotografica dei prodotti ha il solo scopo di presentazione per la vendita e può non essere perfettamente rappresentativa delle sue caratteristiche ma differire per colore e/o dimensioni. In caso di differenza tra l’immagine e la scheda prodotto scritta, fa sempre fede la descrizione della scheda di ogni prodotto.

Delizie delle Alpi promuove il commercio responsabile ed esclude qualsiasi responsabilità a proprio carico nel caso di acquisto effettuato da parte di minori di 16 anni.

2. Registrazione sul Sito.  Per procedere all’acquisto di uno o più Prodotti il Cliente, indipendentemente dalla preventiva registrazione sul Sito che rimane facoltativa, dovrà fornire al Venditore tutti i dati necessari per consentirgli di dare esecuzione all’Ordine. I dati saranno trattati a norma del D.lgs. 196/2003 e del Reg. UE n. 2016/679 (GDPR), in materia di protezione dei dati personali.

3. Mancata disponibilità dei Prodotti. Il Venditore non garantisce la completa disponibilità dei Prodotti presentati sul Sito. In caso di indisponibilità, il Venditore provvederà a comunicarlo al Cliente via e-mail. In tal caso non vi sarà accettazione da parte del Venditore, pertanto il Cliente avrà diritto al rimborso integrale delle somme versate.

4.Dati del Cliente e numero d’Ordine. Il Cliente si impegna a comunicare i dati personali e non quelli di terzi ed in ogni caso di comunicare dati veritieri, non di fantasia o d’invenzione. In ogni comunicazione successiva all’Ordine, il Cliente dovrà utilizzare il numero d’Ordine comunicato dal Venditore.

5. Modalita’ di pagamento e/o fatturazione

5.1Modalità di pagamento. Il Cliente potrà pagare utilizzando una delle seguenti modalità di pagamento: paypal, carta di credito o prepagata, bonifico bancario.

5.2Modalità pagamento con carta di credito. Il pagamento tramite carta di credito dovrà essere effettuato secondo le indicazioni indicate sul Sito e le carte di credito accettate dal Venditore sono: Visa e MasterCard. Il Cliente indicando come modalità di pagamento la carta di credito autorizza il Venditore ad utilizzare la propria carta di credito e ad addebitare nella stessa l’importo della spesa sostenuta.

5.3 Momento del pagamento e interessi moratori. Il Cliente pagherà integralmente il prezzo dei Prodotti ordinati, compresi i costi di trasporto e i costi relativi alla modalità di pagamento prescelta, successivamente all’inoltro dell’Ordine. In caso di pagamento tramite bonifico bancario il Cliente dovrà pagare entro 2 (due) giorni lavorativi dal ricevimento della “Conferma Spedizione” in cui saranno indicati gli estremi bancari su cui effettuare il pagamento. Nel caso di mancato pagamento, il Venditore non provvederà alla spedizione dei Prodotti fino al pagamento integrale degli stessi.

In caso di pagamento tramite carta di credito, il Venditore provvederà all’addebito dell’importo dovuto entro la data di spedizione dei Prodotti.

In caso di ritardo nel pagamento saranno dovuti dal Cliente gli interessi di mora a norma del D.lgs. 231/2002 e sue successive modifiche.

Emissione fatture. Il Venditore emetterà la fattura e questa sarà allegata ai Prodotti consegnati e/o inviata anche in formato elettronico. Nessuna variazione dei documenti fiscali potrà essere effettuata dopo l’emissione degli stessi.

Passaggio di proprietà. I Prodotti rimangono di proprietà del Venditore fino alla consegna degli stessi al Cliente.

6. Consegna dei prodotti

6.1 Modalità e termine per la spedizione. La spedizione dei Prodotti avverrà con le modalità scelte dal Venditore, entro 5 (cinque) giorni lavorativi dalla Conferma d’Ordine.

6.2 Mancato ritiro dei Prodotti. Nel caso in cui il Cliente non sia rinvenuto all’indirizzo previsto per la consegna dei Prodotti e questi ultimi siano restituiti al Venditore, il Cliente resterà obbligato al pagamento del prezzo eventualmente non corrisposto prima dell’invio dei Prodotti.

Il Cliente autorizza il Venditore ad addebitare i costi di giacenza sostenuti per ritardo nella consegna dei Prodotti imputabile al Cliente, con addebito dell’importo dovuto tramite carta di credito, se il pagamento accordato era con carta di credito. Il Cliente nel caso abbia scelto il bonifico bancario come modalità di pagamento, si impegna a pagare al Venditore i costi di giacenza dei Prodotti entro 2 (due) giorni lavorativi dalla richiesta di pagamento inviata via email da Venditore al Cliente.

6.3 Rischio di perdita o danni ai Prodotti. Il rischio di perdita o danni ai Prodotti durante il trasporto rimarrà in capo al Venditore sino alla consegna al Cliente. I Prodotti sono venduti con la clausola di resa merce DAP (Reso al luogo di destino) Incoterms 2010, e quindi nel caso di esportazione il Venditore non ha l’obbligo di sdoganare la merce, pagare eventuali diritti locali di importazione o espletare eventuali formalità doganali, che restano in capo al Cliente, il quale dovrà altresì pagare l’imposta sul valore aggiunto (IVA) applicabile nel suo paese.

6.4 Mancata o ritardata consegna per causa di forza maggiore. Il Venditore non sarà responsabile della mancata o ritardata consegna dovuta a cause di forza maggiore, quali – a titolo esemplificativo e non esaustivo – scioperi, provvedimenti della Pubblica Autorità, razionamenti o penuria di energia o materie prime, difficoltà di trasporto, incendi, alluvioni, terremoti, allagamenti, guerre, insurrezioni, pandemie. Il Venditore provvederà a comunicare tempestivamente al Cliente il verificarsi e il venir meno di una causa di forza maggiore. Qualora la causa di forza maggiore persista per un periodo eccedente i 30 (trenta) giorni, ciascuna delle Parti avrà facoltà di recedere dal Contratto. In caso di recesso ai sensi della presente articolo il Cliente non avrà diritto ad alcun indennizzo o risarcimento a qualsiasi titolo, fermo restando il diritto alla restituzione di quanto eventualmente già pagato per il Prodotto oggetto dell’Ordine.

6.5 Estratto costi di Spedizione

ITALIA -> 15,00€ Tariffa Unica per ordini inferiori ad € 99,00. Spedizione gratuita per ordini superiori.

GERMANIA -> 13,90€ Tariffa Unica per ordini inferiori ad € 120,00. Spedizione gratuita per ordini superiori.

AUSTRIA -> 13,90€ Tariffa Unica per ordini inferiori ad € 120,00. Spedizione gratuita per ordini superiori.

SLOVENIA -> 13,90€ Tariffa Unica per ordini inferiori ad € 120,00. Spedizione gratuita per ordini superiori.

FRANCIA -> 16,90€ Tariffa Unica per ordini inferiori ad € 120,00. Spedizione gratuita per ordini superiori.

7.Garanzia

 

7.1Termine di decadenza e di prescrizione. Ove il Cliente riscontri vizi e difetti nei Prodotti oggetto di acquisto potrà contattare il Venditore, a pena di decadenza entro 48 ore dalla consegna, e denunciare il vizio. Trascorso tale termine il Venditore non sarà responsabile per vizi riscontrati dal Cliente.

7.2 Comunicazione del vizio.  Il Venditore invita il Cliente a descrivere nel modo più dettagliato possibile la natura del vizio riscontrato ed eventualmente a trasmettere in copia i documenti dell’Ordine, indicare il numero dell’Ordine, e ogni altro dato utile alla corretta identificazione del reclamo.

7.3 Riparazione o sostituzione. Il Venditore provvederà, a seconda dei casi, ad effettuare la sostituzione del Prodotto entro un termine congruo dall’accertamento della effettiva sussistenza del vizio. In caso di impossibilità di sostituzione del Prodotto il Cliente avrà diritto esclusivamente alla restituzione del prezzo pagato, escluso ogni e qualsivoglia danno. Per poter rispedire merce all’offerente è necessario che il cliente abbia il relativo documento d’acquisto. La rispedizione della merce è a carico e sotto la responsabilità del cliente. La merce inviata per errore viene ripresa indietro solamente nell’imballaggio originale non aperto e non difettoso. Per i clienti privati vale la legge 50/92: Il cliente può cambiare idea entro 7 giorni dall’ordine. Il cliente che cambia idea deve comunicarlo a mezzo lettera A.R. all’offerente. Il cliente deve rispedire la merce all’offerente a sue spese. L’offerente si riserva il diritto di sostituire un prodotto con un prodotto equivalente. 

7.4 Esonero della garanzia. I Prodotti non saranno oggetto di alcuna garanzia per vizi nel caso in cui il Cliente abbia fatto un uso non corretto dei Prodotti, o qualora i Prodotti siano stati alterati o modificati o siano stati conservati in modo non adeguato tenuto conto delle caratteristiche dei Prodotti.

7.5 Ritiro di Prodotti difettosi. Il Cliente si impegna a supportare il Venditore, nel ritiro dal mercato degli eventuali Prodotti difettosi o in caso di campagne di richiamo.

8. Limitazione di responsabilita’

Il Venditore è responsabile esclusivamente per i danni diretti e prevedibili al momento della conclusione del Contratto, salvo il caso di dolo e colpa grave. Il Venditore non è pertanto responsabile per eventuali perdite subite, il mancato guadagno o qualsiasi altro danno subito dal Cliente che non sia conseguenza immediata e diretta del suo inadempimento, o che non fosse prevedibile all’atto della conclusione del Contratto.

9. Clausola di non pregiudizio

Il mancato esercizio da parte del Venditore dei diritti previsti dal presente Contratto, così come un comportamento di tolleranza in talune situazioni in cui egli possa far valere dei propri diritti, non comporta nei confronti del Cliente la rinuncia al diritto medesimo.

10. Legge applicabile e Foro competente

Le presenti Condizioni Generali di Vendita Online sono regolate dalla legge italiana. Ogni controversia relativa all’interpretazione ed all’esecuzione del Contratto è devoluta alla esclusiva competenza del Foro di Trieste.

art.1 “Prezzi”; art. 5 “Modalità di pagamento e fatturazione”; art.6 “Consegna dei Prodotti”; art. 7 “Garanzia”; art. 8 “Limitazione di responsabilità”; art. 10 “Legge applicabile e foro competente”.
